Court On Infant’s Petition Over Denial Of Maternity Leave

The Delhi High Court has granted the last opportunity to NDMC to respond to a petition by a three-month-old child against the denial of maternity leave to his mother, an employee of the corporation.

The high court said there was urgency in the matter as the child is suffering irreparably when he is deprived of his mother’s care.

A bench of Justice Najmi Waziri and Justice Swarna Kanta Sharma took into account the “tender age” of the petitioner and allowed “one last opportunity” for North Delhi Municipal Corporation (NDMC) and other respondents to file their reply to the petition within two weeks.

The bench said the NDMC and other respondents are given the opportunity to file the response subject to payment of costs of Rs 25,000 to be deposited with the Deputy Conservator of Forest (South), Delhi for not responding to the notice issued to them on March 3.

“Should the reply not be filed within the said time, the right to file reply shall stand closed. There is urgency in the matter, especially because at his tender age the petitioner suffers irreparably when with each passing day he is deprived of his mother’s care,” the court said in its order dated April 29.

The court directed that costs be deposited within three weeks and DCF may consider planting certain trees in forest lands in the Southern Ridge and stated that to the extent possible, community participation in the plantation and maintenance of the trees may be encouraged.

In the present case, the benefit of maternity leave was denied by NDMC in view of the petitioner being the third child of his parents and the petitioner argued that refusing him maternal care is in violation of his rights under Articles 14 and 21 of the Constitution of India.

The court noted that denial of maternity leave was based on the service rules which limit the benefit to female government servants with less than two surviving children.

Looking at the nature of the case, the court-appointed lawyer Shahrukh Alam as amicus curiae and directed that the case be listed for consideration on May 17.

North Delhi Civic Body Fined Rs 50 Lakh Over Fire At Landfill Site


Bhalswa fire, Delhi: The Ghazipur landfill has seen three such fires since March 28.

New Delhi:

The Delhi Pollution Control Committee (DPCC) has imposed a fine of Rs 50 lakh on the North Delhi Municipal Corporation for being negligent and not taking proper steps to prevent the fire at the Bhalswa landfill, officials said on Thursday.

Environment Minister Gopal Rai had earlier asked the anti-pollution body to probe the incident and submit a report within 24 hours.

“The North MCD did not take proper steps to prevent and contain the fire. As per the standard operating procedure, the MCD should have kept water tankers on standby to deal with such a situation,” an official said.

The fire started in a small area on Tuesday, but it spread due to the negligence of civic officials and engulfed the entire mountain of garbage, he said.

Mr Rai on Wednesday said the BJP-ruled municipal corporations should have used the bulldozer to clear the mountains of garbage in Delhi and that repeated incidents of fire at landfills in the capital are a result of corruption in the civic bodies.

On April 21, Mr Rai had said the Delhi government would study a system installed in Mumbai to capture methane from the rotting waste and replicate it in the national capital to prevent fires at landfills.

The Ghazipur landfill has seen three such fires since March 28.

The wet waste dumped in a landfill produces methane when it rots. In hot weather conditions, methane catches fire spontaneously and the blaze spreads as it feeds on combustible material such as textiles and plastics.

Adesh Gupta writes to east, south Delhi mayors for anti-encroachment drives

A day after North MCD razed several “illegal” structures in violence-hit Jahangirpuri, the BJP’s Delhi unit chief Adesh Gupta wrote to the mayors of south and east Delhi to conduct anti-encroachment drives in their areas.

Adesh Gupta has asked the mayors of east and south Delhi to end the “encroachment of government land by Bangladeshi, Rohingyas and anti-social elements.”

“Under the patronage of the AAP MLAs and leaders, anti-social elements have made numerous illegal encroachments in your area,” he added.

In a letter written to SDMC Mayor Mukkesh Suryaan and EDMC Mayor Shyam Sunder Agarwal, Adesh Gupta has asked them to “identify” the encroachment by anti-social elements and “bulldoze them”.

On Wednesday, the North Delhi Municipal Corporation launched an anti-encroachment drive in Jahangirpuri following Gupta’s letter that came after violence erupted in the area during a Hanuman Jayanti procession.

However, the drive was halted after the Supreme Court ordered to maintain the status quo.

Delhi May Soon Get A “Waste-To-Art” Park To Showcase Iconic Monuments

The standing committee of the North Delhi Municipal Corporation on Friday approved a proposal to build a park on the ‘waste-to-art’ theme on the premises of the historic Ajmal Khan Park in Karol Bagh, officials said.

The South Delhi civic body had come up with a ‘Waste-to-Wonder’ Park in Sarai Kale Khan in February 2019. It has replicas of seven world-famous monuments, including the Taj Mahal and Eiffel Tower, fashioned out of mechanical waste.

“The standing committee of the North Delhi Municipal Corporation in its meeting today approved a proposal to build a ‘waste-to-art’ park in the old Ajmal Khan Park in the Karol Bagh area. The park is spread over nine to 10 acres,” a senior official said.

The approval now awaits the nod of the NDMC House.

According to the proposal, 13 sculptural models of world-famous heritage landmarks will be set up in the park, including the Great Sphinx at Giza, the Great Wall of China, Opera House in Sydney, Sagrada Familia of Barcelona and Stonehenge of the United Kingdom.

Also, 12 artworks will be done in relief, including models of Angkor Wat at Cambodia, Chichen Itza of Mexico, the Grand Mosque of Abu Dhabi, London Bridge, Mount Rushmore in the US and Petra in Jordan, it says.

According to the proposal submitted in the meeting of the NDMC panel, the estimated cost of the project is Rs 27.14 crore.

On December 24, Union Home Minister Amit Shah had inaugurated ‘Bharat Darshan Park’, built by the SDMC in Punjabi Bagh, with the same concept.

Replicas of 21 Indian monuments, including the Victoria Memorial Hall and the Mysore Palace, are installed in the park in south Delhi.

The ‘Bharat Darshan Park’ was built with scrap and waste material, at a cost of nearly Rs 20 crore.

Delhi Lt Governor Anil Baijal, in a February 2020 event, had said the ‘Waste to Wonder Park’ was a shining example of the “waste-to-wealth” concept and the SDMC should develop more such parks.

North Delhi Municipal Corporation extends property tax amnesty scheme till February 15


The North Delhi Municipal Corporation has extended the last date for the first phase of the amnesty scheme for payment of property tax from January 31 to February 15.

The civic body standing committee chairman Jogi Ram Jain said that in the first phase of the amnesty scheme, 100 per cent waiver of interest and penalty and 15 per cent rebate on principal amount is being given to taxpayers on lump-sum payment of outstanding property tax.

Due to the weekend curfew and Covid-19, Jain said, the citizens were not able to take advantage of the first phase of the amnesty scheme and thus it has been extended.

Jain added that citizens can make use of the amnesty scheme in the second or third phase if they are not able to pay the outstanding property tax in the first phase.

Indore retains title of cleanest city for 5th time in a row | India News


NEW DELHI: In a laudable feat, Indore retained the tag of the cleanest urban local body (ULB) for the fifth time in a row, while the biggest show of improvement was of Noida, which jumped from 40th position in 2020 to 9th this year among ULBs with more than one lakh population, according to the government’s cleanliness survey.
In the Swachh Survekshan 2021 results announced on Saturday, the New Delhi Municipal Council (NDMC), which covers the Lutyens’ Bungalow Zone, also improved its ranking to 5th from last year’s position of 8th among ULBs.
The NDMC also received the award of being the cleanest city in the category of ULBs with ‘1-10 lakh’ population.Unlike last year, the annual swachhta (cleanliness) survey did not put out a comprehensive list of ULBs under the category of ‘more than 1-lakh population’.
This year, it published ULB-wise scores, which TOI used for comparing the ranking of municipal areas under two categories like last year – ‘less than one lakh’ and ‘more than one lakh’ population.
The three municipal corporations in Delhi and its Cantonment Board did not have a score to make it to list of the ‘top 100’ in the one-lakh plus category. However, in the sub-category of 48 ULBs with more than 10 lakh population, municipal corporations of South Delhi, East Delhi and North Delhi ranked at 31, 38 and 43, respectively.
President Ram Nath Kovind gave away the awards to the top-ranking cities at an event in Delhi. Appreciating Indore’s performance, Kovind said while winning the top position is an achievement, to retain it is a bigger challenge.
Among all ULBs with less than one lakh population, eight out of the top 10 were from Maharashtra – Vita emerged as the cleanest among them, followed by Lonavala.
Since the inception of the national-level survey of ULBs in 2016, the housing and urban affairs ministry has introduced changes in the scoring pattern, which it claims to make the findings more accurate and progressive. To that end, this year, it increased the citizens’ feedback to a maximum score of 1,800 compared to 1,500 in the 2020 survey. Interestingly, some ULBs which could not make it to the top 10 among the one lakh-plus population category, had recorded more scores in public perception about cleanliness of their cities.

Swachh Survekshan: New Delhi Municipal Council tops list, Delhi corporations put up dismal show


The New Delhi Municipal Council topped the Swachh Survekshan survey in the category of cities with one to 10 lakh population. The dismal show of the municipal corporations of Delhi, however, continued with the north and east Delhi civic bodies finding themselves in the bottom 10 list of cities with a population above 10 lakh.

President Ram Nath Kovind presented the Swachh Survekshan Awards 2021 at Delhi on Saturday. Indore topped the category of cities with a population above 10 lakh. It is followed by Surat, Vijayawada, Navi Mumbai and Pune, rounding off the top five.

The North Delhi Municipal Corporation ranked 45 among 48 civic bodies having a population above 10 lakh. Only three other cities, Coimbatore, Kota and Madurai have ranked below it.

The East Delhi Municipal Corporation ranked 40 out of 48 cities in this category. Among the three corporations of Delhi, the South Delhi Municipal Corporation secured the highest rank of 31.

Last year, the East Delhi Municipal Corporation had ranked 46 among 47 local bodies in its category in Swachh Survekshan. Whereas, the South and North had ranked 31 and 43, respectively.

The Swachh Survekshan ranks cities and urban local bodies on various parameters like waste segregation and garbage disposal, among others, as part of the Centre’s Swachh Bharat Mission.

A senior New Delhi Municipal Council official said that the result was owing to the council’s efforts to continuously pursue excellence in providing services and civic amenities.

Delhi HC directs forest department to examine if 60-year-old peepal tree is dangerous


The Delhi High Court Thursday questioned the manner in which the North Delhi Municipal Corporation had attempted to carry out the transplantation of a 60-year-old peepal tree at Inderpuri and directed Delhi’s forest department to examine the tree afresh to check whether it is dangerous or not.

On October 28, the court had directed the authorities to not harm or remove the tree in any manner and halted the NDMC action midway after senior advocate N Hariharan mentioned that the 60-year-old tree near his residence was being illegally cut. The court had said that grave and irreparable harm will be caused not only to the environment but also the residents of the locality if the tree is permitted to be cut.

Pulling up the NDMC, Justice Sanjeev Sachdeva Thursday asked the civic body to explain how it was possible to transplant such an old tree and observed that its removal may require bringing down of some houses in the vicinity of the tree.

“How are you going to remove the roots of the tree? What was the requirement? This is not how the trees are transplanted. If you are pruning the tree in such fashion, this will not survive,” said the court, adding the tree may not survive if it is removed in such a manner.

On Thursday, the NDMC told the court that the existence of the tree had become dangerous due to construction in a nearby building. The counsel representing the Deputy Conservator of Forest (DCF), however, told the court that its permission for relocation of the tree has since lapsed and thus the petition before the court has become infructuous.

The court, after seeing photos of the tree, in the order noted that prima facie there was no danger of the tree falling as no tilt or sagging was observed. It also noted that the building where construction was taking place has since been completed, while directing the DCF to examine the tree again.

Delhi’s First Dog Park Has Swings For Canines, Artistic Caricatures


Beautifully depicted dog caricatures and paintings are drawn throughout the park.

New Delhi:

North Delhi Municipal Corporation on Saturday inaugurated Delhi’s first dog park at Rajinder Nagar where people can take their pets for a stretch and stroll, the civic body said in a statement.

The dog park was inaugurated by North Corporation Mayor Raja Iqbal Singh.

Mr Singh said the dog park comprises swings, green patches for canines and their pet parents so that they can enjoy a good walk and some good rides together.

“With the advent of the COVID-19 pandemic life of pet dogs and pet parents got confined to indoors and within limited space, making them fall prey to lifestyle diseases. Delhi’s first dog park will help the pets to stay fit, rejuvenate & recreate in safe open spaces like parks,” Mr Singh said in the statement.

Assistant Deputy Commissioner, Karol Bagh Zone, Vishakha Yadav said a seamless registration counter has been installed to ensure adequate safety measures for the pets and the pet parents.

Beautifully depicted dog caricatures and paintings are drawn throughout the park giving it a lively atmosphere.

“Different kinds of swings, including the ones made out of waste, will enthral the pet lovers and their babies,” she said in the statement.

Free check up and free anti-rabies vaccination camp for pets were also organised during the inaugural ceremony.

Such dog parks already exist in Hyderabad and Bengaluru. The South Delhi Municipal Corporation is also working on a similar concept to open a pet park by March next year.
